I bought a house with my sister and her husband and we are all on the deed and the loan. now my brother in law wants to be removed from the deed but he is ok with staying on the mortgage can that be done or must i remove him from both

you can remove him from the title to the property without taking his name off the loan. if he wants his name to be removed from the property title, he can sign a quit claim deed and transfer his share of the ownership to you and your sister. however, if you want to remove him from the loan as well, you will have to refinance.
