hello, i purchased about 30 acres and a home about 1 year and 1/2 ago and recently got it surveyed, after the survey was complete there was about an acre that the neighbor had pretty much taken over and i am guessing the previous owners didnt really notice or care, he refused to move his junk cars from it so i contacted the police and they said i would have to get a quit claim deed before they could enforce anything, they stated the survey was not enough because its still my word against the neighbors of whose property it is. does anyone know if this will be a legal battle or is there a way to solve it easily, i am getting ready to split the property so i can sell the home and 5 acres and i need to get this resolved.[/list][/u]
Hi gitech,
If you have the quit claim deed which mentions the details of the property, you will be able to force your neighbor to remove his junk cars from your property. You can offer a copy of the deed to the police who will then take action against your neighbor. If your neighbor does not remove the junk cars from your property, then you can think of legal actions against him.
Take care.
