i divorced in 2004 and i was awarded in my divorce decree the house. i obtained my own mortgage right after the divorce. my ex-husband was at the closing and signed papers to transfer the property or so it seemed.
fast forward several years and i went to refinance my mortgage and was told that the title was still in my former married name and that my ex-husband's name was still on the title. note that my ex-husband died after our divorce.
question:
how do i remove my ex-husband's name from the title and what are the issues since he has died? also, i assumed that the title company would have had the title updated at the time of our divorce. i do not have a quitclaim deed showing that this occurred. i assumed that is what my husband signed at the time of closing.

You need to contact an attorney and check out how you can remove your ex-husband's name from the property deed. The real estate attorney will guide you in this matter. Unless there is a quitclaim deed in place, the title company won't update the property deed.
