my husband and i are getting a divorce. both our names are on our mortage. if he quit claim deed the house to me can i remove his name from the mortage and carry on as usual?[/b]

You cannot remove your spouse's name from the loan just by asking him to quitclaim the house over to you.

Sara has rightly said that you cannot remove you husband's name from the deed on your own. If he just quitclaims the property to you then his name will be removed from the deed.
But in that case also you will have to take the mortgage on your own name by refinancing to release your husband from the mortgage obligations as you will be then the only owner of the property.
