removing a name from real estate

I am separated but not yet divorced and want to remove my husbands name from the property. This home was previously my parents' home and after my father died,my mother gave me the house when she moved into a condo. She only added my husband at my insistance, but kept her name on it as well. How do I remove his name and keep mine and my mother's name on the house? He has agreed to do this as he knows that she intended the house go to me and our son.

You can ask your husband to sign a quitclaim deed in your mother's and your name. Once he signs a quitclaim deed, you can notarize it and record it at the county recorder's office. Once this is done, the property will be transferred to your name and your mother's name.

Sample quitclaim deed forms are available online. However, to be on the safer side, you can even draft it from an attorney.
