i own a house and my co-signer who moved out of the states filled for bankruptcy. now i need to remove her name from the mortgages loan and the deed. my mortgage bank wants me to do a quit claim deed but she refused to sing any papers. she is not answered my call, email or letter. what should i do in order to get the quit claim deed sign? or how can i get her off from my loan?. last time i talk to her, she doesn’t want to do anything with my house and want to remove her name from the loan.

you can refinance the mortgage in order to get the loan transferred in your name. however, unless your co-signer quit claims the property to you, you won't become the sole owner of the property. you can file a partition lawsuit which will help you in selling off the property. after the court orders the property sale, the loan will be paid off first and then the rest of amount will be divided between both of you.

I cant refinance at the moment, because I am few month behind in, I was doing the Home modification and it was approved but they canceled because she filled for bankruptcy. But now that she got discharge, they mortgages bank want me to send a Quit Claim deed so they can remove her name from the loan. The house is 100% mine, it is on the deed too, she knows that but she doest want to sign any paper because her bankruptcy lawyer told her no to sign anything.
I still dot know what to do? Can I lawsuit her bankruptcy lawyer?
