MY HUSBANDS NAME IS ON THE DEED TO HIS MOTHERS HOUSE ALONG WITH HER NAME AS WELL. HE WOULD LIKE TO HAVE HIS NAME REMOVED FROM THE DEED. THERE IS NO MORTAGE ON THE HOUSE, IT IS PAID IN FULL. HOW DOES HE GO ABOUT THIS AND ROUGHLY HOW MUCH WILL IT COST? THANK YOU
Hi PWILLI,
In order to remove his name from the deed, you husband needs to sign a quit claim deed whereby he would give up his interest in the property.
You need to pay certain taxes like doc stamp taxes, recording fees etc which varies from one state to another. You can get in touch with the county recorders office to know how much taxes you exactly need to pay. He can quitclaim his share as gift also and can claim certain gift tax exemptions.
