Is quit claim all you need to remove a name from mortgage

i am divorced, my ex signed a quit claim deed for the house that we owned and lived in while married. i faxed the quit claim to the mortgage co and asked them to remove his name--they said i had to refinance or do another transaction that would cost roughly $1000!! is this right???

If your ex-husband's name remains on the mortgage docs, he would be financially responsible for the loan. Also, this will make it difficult for your ex-husband to get a new loan to buy a property.

keisha, with interest rates at record lows, i find it surprising that a refinance would cause your rate to increase as you noted. shop around some more and see if you can't find a more favorable rate.

If I remove my name off of a jointly held property through a quit claim deed, am I still liable for payments?

Hi RHLamoureux,

Once you remove your name from the property deed by signing a quitclaim deed, you will not be liable for the property taxes or maintenance of the property. However, if your name is mentioned on the mortgage docs, then you will be liable for the mortgage payments.
