quit claim deed

My mother-in-law owns a house free and clear and wants to give it to us, a married couple. Does she quit claim it to us and that will remove her name from title as well as her interest in said property. Then can we record a new Grant Deed in our names only?

Your mother-in-law can sign a quitclaim deed in your name and once the deed is properly filled up, you will have to notarize it and record it at the county recorder's office. Signing a quitclaim deed will remove your mother-in-law's name from the deed and she will have no further interest in the property.

You can get sample quitclaim deed forms online but it is better to draft the deed from an attorney.
