My question is I am getting a divorce we have been seperated 2 years my husband has had the house the whole time. The bank has informed me that he is 3 months behind I need to get my name off of the mortgage before it does any more damage to my credit. Any suggestions

in that case you may ask your husband to refinance the loan in his name and remove your name from the mortgage note.
but if he is already 3 months behind in making payments, then i'm not sure if the lender will approve him for a refinance.
the other option could be a novation to remove your name but you have to talk to the lender and see if he is willing to do so.

You cannot just remove your name from the mortgage. You are jointly responsible for the mortgage amount until you are released by the mortgage company. You can ask the mortgage company to allow your husband to assume the full mortgage, but it is not likely to do so. The only other option is talk to your divorce lawyer and see if the court can order it as part of the divorce.
