Quit Claim

Posted on: 20th May, 2010 11:24 am
my house is mortgaged with an ex partner which i am now divorced from. I want to get his name off the martgage as he pays nothing towards the repayments and i dont want him to be able to have any say in selling the house if i decide to. Does getting a quit claim mean he has no say in whether i want to sell the house?
Hi Clarabell!

Welcome to forums!

Your ex-partner needs to sign a quit claim deed and transfer the property to you. Once he does so, you would become the sole owner of the property. Thus, your ex-partner will have no say while you sell off the property. As far as the mortgage is concerned, you will have to refinance the loan in your name. This will make you solely responsible for the mortgage.

Feel free to ask if you've further queries.
