removal of an ex-spouse from a house deed

I just got married to my spouse. Before we married he was divorced for 2 years. I was researching and had learned that he pays a morgage on his house, only him. The morage is in his name. I notice that the deed has his ex- wife name on the house as a owner of the property with him. Can they feel out a quick deed form to take her off the house? Thanks from Kelleye Cooper

He can get a quit claim deed signed by his ex-spouse where she would sign over her interest to him. It will not be possible to remove her from the title unless she signs the deed.

You already know that your husband had divorced her 2 years ago.
now she has not any relation with your husband but if deed is on her name your husband can use quit claim deed to remove his wife's name from his houses deed.

You need to request to your husband to do that.

IN the event that a divorce decree states that the house would be sold by both parties and one of the parties refuses to do so when there is a curent mortgage with both husband and wife holding interest, how would I be able to remove myself from the mortgage should she not want to sell and not want to pay the mortgage?

Hi Bob,

As the court has mentioned in your divorce decree that both of you need to sell off the property and pay off the mortgage, the wife cannot refuse to it. If she refuses it would be considered as illegal and the court can take legal steps against her.
