We are in the process of buying a home, and it is a repo home owned by the VA, we are not getting a VA loan to buy the home. Upon closing they want to use a quitclaim deed instead of a standard deed. The house has sat empty for 2 years, and it was up for sale before it was foreclosed on, is there anyway to find out if there is a mechanics lien on it. Legally do they have to disclose information if there is any lien on the home? Our realitor told us that anymore it is standard for VA's to use quitclaim deeds.- and as fare as she knows there are no liens on the home. We live in Kansas.

As far as I know, yes, the owner/seller of the property will be liable for disclosing all the liens that are on the property. Nevertheless, before buying the property, you can even go for a title search if you want to know whether or not there are any liens on the property.

If there is any kind of lien or mortgage on the property, then it is very natural for the seller to use a quitclaim deed while transferring it.
