My wife and I are getting a divorce and she wants me to sign a QD. she says that she will not come after me for any past child support if I do. Can this happen legally and will I still be responsable for the note if she gets behind. We live in Tenn.

if you sign a quitclaim deed, you'll be transferring the property to your wife. if she says that she won't come after you for the past child support, then i think there should be a written agreement in this respect.

though you quitclaim the property to her, you'll be responsible for the mortgage dues if she does not refinance the note in her name.

Are you on the mortgage? If you are, then signing a deed will not relieve you of your mortgage responsibilities. She will have to refinance it in her name to remove you from mortgage. As far as her verbal promise of not coming after you for any past child support is concerned, Adonis is right. There must be a written agreement between she and you and an attorney should be involved in this whole process.
