I quit claimed my home to my daughter with life estate for myself. I have the original quit claim and it has been filed with the court. I've decided to sell my home and downsize. When I bring up the subject of her releasing the quit claim, she won't talk about it and refuses to give me an answer. What can I do?
Do you have a mortgage on the property? According to title, its ONLY in her name? I would consult an attorney to see what you can do in this process..

You won't be able to reverse the quitclaim deed without your daughter's signature. You will have to negotiate with her and ask her to sign a quitclaim deed to transfer the property to you. You can even try to buy her out. You can offer her a certain amount and ask her to transfer the property to you.

hmiller, it's a shame you've put yourself in this predicament. your life estate gives you lifetime use and say in what takes place with the house also. but your transaction that now has your daughter as owner is binding. honestly, you need to work out the situation between the two of you. the attorney that ashley recommends you retain will be helpful, but you don't want any issues remaining if you can help it.
