reversing a quit claim

Posted on: 14th Aug, 2008 11:08 am
:( My husbands brother was quit claimed property by their grandparents, since then the grandparents took out a second on the property for pay for debts of the brother and to buy a boat, the brother made some payments but has since failed to keep up them up, which is now being paid by the grandparents, and they are struggeling to make those payments, well the brother has gone through back and neck surgery for the last few years and has had complications, he is very very medicated, narcatic type medications because of his pain, my husband suggested to the grandparents that they do a reverse mortgage to stop the creditors from calling, the brother will not sign, he says this is his house, and for the grandparents not to even think about it, now the grandmother is very sick in the hospital, and might have to be placed in nursing facility, and my husband thinks we need to get his name off this deed so that we can help his grandparents with what ever comes up, to do the reverse mtg, to sell it, or what ever the situation. i dont think its possible to get him off, and suggested to my husband that he needs to get his own name off the deed so that any debt that comes with that house is not turned over to us, we pay our bills, we strive to keep our credit in good standing, i think that his brother being so stubborn, that that would be our best bet, unless there is something we can do to get his brothers name off the deed, thanks for your help cali
Hi,

Welcome to the forums.

I guess your grandparents should go for a reverse mortgage. But the problem is, they have quitclaimed the house to your husband's brother. So, how about asking him to take his name off in return of paying him some cash amount?
