quit claim question

Posted on: 30th Dec, 2010 08:01 pm
a few years ago I quit claim my home taking my husband off the home so it just shows me as the owner. We are married and did this because we thought a creditor was going to be after us for a large hospital bill.Well we have been paying them $10 per month now so I think we are okay.Anyway if I were to pass away today would my husband have all kind of problems gettting the house in his name again(In my will I am leaving the house to him).I want to know this.Maybe I should reverse the quit claim if that is possible.
Any help would be appreciated
Hi Guest,

As you have a will mentioning your husband as the beneficiary, he will have to probate the will and get the property transferred in his name. If you wish, you can even file a new quitclaim deed and add your husband's name to the property deed thereby making him one of the owners of the property.

I agree with Adonis here; you can do either or both of those things. Given that you've already willed the property to him in the event of your death, transferring ownership interest now isn't really necessary, though it would make things easier when it came time to deal with probate (assuming he outlives you). If the hospital's getting their money, they aren't going to be too fussy, so quit claiming now ought not to present you with any problems, based on what you've told us.
