I signed a Quit Claim Deed while medically incapasitated and hospitalized.

i was hospitalized and under the influence of alot of narcotic medications. i was also seperated from my husband at the time. my husband was informed by a judge that he was to keep me in the marital house, and in no way to leave me without a home. my mother-in-law and my husband came and took me out of the hospital and to a bank and had me sign a document wich i was told was to rent our home because of financial troubles. they told me that they needed to rent the house so we wouldn't loose it and that i would have to move in to my mother in laws house when i was released from the hospital to recover. i later discovered that the document i signed was a quit claim deed. when released from the hospital they refused to allow me to move in my mother in laws house to recover, i had no where to go so i went home to find that they changed the locks on my house that i signed the papers on so i called a locksmith and changed the locks and moved back in. can this signature be over turned concidering i was medically incapasitated?

I think you reversal of the deed will be possible on the ground that when the deed was signed by you, you were incapacitated and you were forced to sign the deed under false pretense. However, to reverse a deed is not very easy which is why you need to consult an attorney, experienced enough to handle this kind of cases.

Thank you for your reply....What type of attorney handles this type of litigation? Forclosure Attorney? Criminal? Civil?

Hi Rae,

I think you should consult a civil attorney to reverse the deed. If you want to bring forgery charges against them you can file a criminal case against them with the help of a criminal attorney.
