Pending foreclosure...

i have been divorced a little over a year and a half. as part of my divorce agreement i was to sign a quick claim and my ex-husband was to "try" to refinance the home in his name only. i didn't realize how ambiguously worded my divorce agreement was until recently. he is now about to lose his job and is asking me to take over the home and he will move out. i am concerned about doing this because i signed the quick claim, is there anyway to reverse this? and short of refinancing the home to get his name off of there (which is impossible at the point because we owe more than what it's worth) i need to know if i have any other options on getting his name off of there...
Hi callmeapril,

Reversing the deed is very much possible. All your husband needs to do is sign over the property back to you. However, if the property is about to go into foreclosure, any such transfer will not be possible as that would be considered as fraudulent conveyance. To remove his name from the mortgage, you need to refinance it in your name.
