Can a person put a quick claim deed on land that was owned buy two brothers ?...My dad & uncle bought land many years ago . When my dad died his estate was left to my mom, many years after my uncle died I learnt he died without a will. A cousin of mine looked after his affears leading all to belive that my uncle did have a will. The property was never surveyed,my cousin has put a Quitclaim deed on all the property. What can I do to save my mom's part of the land that she has payed taxees on all her life & can this person have the right to do this ??
Hi piccott,
After your uncle's death, you cousin might have inherited your uncle's share in the property. But that does not imply that he is entitled to the whole of the property. Your cousin can quitclaim only his share of interest. He cannot transfer the share of property that your mother owns to anybody else.
