quit claim

if me and my spouse are going to eventually divorce in the near future and he signs a quit claim on the property will this legal document save my home when we do go to court and not to sell the house???

Welcome to the forums.

Did you spouse transfer you the property rights entirely? I guess he doesn't want any share of interest in the property. So, why would he sell the home forecefully? I guess this is what you may be afraid of but don't worry. As much as you say, doesn't reveal that he has such intentions.

Are there any financial obligations on the property? If there is a loan/debt on your spouse's name, then it cannot be transferred through quitclaim.

Hi Melissa,

Welcome to the forum.

Sara has given you sound info. I agree with her that if your spouse quitclaims the property to you then he will have no rights or claims on that property. But you should notarize and record the deed in the county recorder office to make the deed valid.
