Quitclaim deeds, second marriage and property

Posted on: 19th Sep, 2010 05:57 pm
My Mom bought a house in 1965 after my father died same yr. In 1970, she remarried,,, it's my Mom's house, bought 5 yrs before her second marriage, and his name was never put on the deed. If she dies first, does her second husband get half her house?? He sign'd quitclaim deeds on her house in 1979. He's never made a house payment,, and came into the marriage with only his clothes. He still has nothing. Everything in the house is my Moms. They are both in their 80's.
Hi neknosredna437,

Does your mom has a will? If not you can get it done.I think you wish to protect your mom's property from your step -brothers/sisters.As far as laws are concerned your step father is entitled to get some pie of the property if there is no specific will.

If your mother makes a will & get it notarized and then mention the distribution of the property then surely it will be done as per her wishes.

Feel free to ask any further query if you have.
