should I get a quitclaim from my wife as we are filing for divorce.

Posted on: 09th Mar, 2009 02:15 pm
She left and returned to Costa Rica 13 years ago, not a US citizen or legal resident. However, she wants to marry an American now but needs a divorce from me in order to do so.
How can I secure my house and bank accounts just in case?
Hi allaneu,

Having your wife sign a quitclaim deed to secure your house and property is a good option. As you haven't got divorced yet, she is still your legal wife. Thus I don't think getting a quitclaim deed signed by her would be a problem for you, even though she is not an US citizen. But you can check your state laws and consult an attorney in this regard.
