Divorced, prior property, quit claim deed

while married, our house was purchaed by a "we buy houses" type, poa turned over to the company regarding payment coupons, mtg interest ect. they have yet to refinance it into the company's name. now i am divorced, trying to secure my own mortgage loan and this house is stopping me. this house is not mentioned in the divorce decree at all. is it possible for me to file a quit claim deed on this property? will my ex have to agree?

Are you on the mortgage? If not then you can quitclaim the property to your husband. But if it is a mortgaged property then the loan should be refinanced to take you name out of the mortgage.

To whom do you want to quitclaim the property, your ex-husband or to the company? If you want to quitclaim to the company then you will need to take confirmation from ex-husband.

I think you should consult with the company and your ex-husband ASAP and fix it because more you delay, it will take more time to buy the new house.
