My moms name is on my grandpas house. Her name only. My grandpa is dead but his common law wife is still living there. My mom wants to put my name on it & take hers off. When the common law wife dies will I be able to sell it? Do we do a quik claim deed at the abstract office or do we need an attorney?
Welcome Ghullinger,
I hope your mother has removed your grandfather's name from the property deed with the help of an affidavit of heirship. Your mother can sign a quitclaim deed and transfer the property to you. Once you are the owner of the property, you can sell it off.
