My exhusband quit claimed our house to me, does he need to sign mortgage papers for the short sale...My ex is still on the mortgage and the judge had him quit claim the house to me. I have agreed with the mortgage company to short sale the home. Does the quit claim give me the right to sign all the papers or does my ex still need to sign? If the quit claim lets me make the decisions on the house, wouldn't him having to sign the paperwork give him a right in the decision making???? I know people who have had a quit claim & they did not need the other person to sign the mortgage papers to sell the house.

Your husband doesn't have to sign on the mortgage papers. A quitclaim is a legal process that transfers one's share of interest to another. Thus, after quitclaim, the person who transferred the property doesn't hold any interest in the property. The grantee now becomes the legal owner and reserves the right to make decisions regarding the house.
