can my ex-husband force me to sign a quit claim deed if he didn't refinance the house after the divorce and it remained on my credit for eight years? the house is paid off now but i had to pay hgiher interest rates for eight years because he coldn't/wouldn't refinance...
No one can force you to sign a quit claim deed and ask you to transfer the property. If your ex-husband is doing so, then that can be considered as illegal. You can contact an attorney and take legal steps against him.
I was really wondering what his/my legal options were...I would like to negotiate a payment of my increased interest costs over the eight years in return for signing the quit claim deed now and I didn't know if I have any legal standing to do this or if he could just go to court and ask them to make me sign the deed now that the house is paid off..The divorce decree gave thehouse to him.but he was supposed to refinance immediately
Are you saying you continued to pay the mortgage or part of the mortgage after the divorce???
If you continued to pay some or all of the mortgage yourself and the divorce decree stated he must refinance by a certain date, I would guess you may have legal grounds to get some of the money back that you continued to pay since he never refinanced to take your name off the existing mortgage. The attorney you see will cost you money and you would have to weigh that aginst how much you think you are owed.

Gosh, I appreciate all of the feedback and I WILL be seeing an attorney...but no I did not make any of the mortgage payments over the eight years after we divorced, but he also did not refinance the house, he then missed payments on the mortgage and negatively affected my credit...my question is....can I recoup any of these costs I incurred due to him not following the divorce decree and refinancing....I leased a vehicle in 2004 and my payments were $100 higher per month because of his missed payments on the mortgage..... I was hoping to use his need for me to now sign the quit claim deed as a leverage point, but I don't want to do anything illegal...

You are not doing anything illegal. Now we understand why you have extra interest charges.
It would never hurt for you to try and get some money back. Dpends on how much you want back versus the attorney cost and when you are awarded money back, does he have the money to give you. Obviuosly equity in the house, but, if his credit is shot he can not get a mortgage to pay you.
