Can a person sign a quick claim deed under the influence of drugs(Morphine)?

My Grandmother had Ovarian Cancer and was taking morphine until she died. My aunts had her sign a quick claim deed on her portion of the deed. I own the other half 50%. My aunts did this when I was out of state. I had no knowledge of this until I went to the Recorders office and I was told of the transaction. I was told that a person under the influence cannot sign a deed to real estate. Is that true? Now they are taking me to court and I have an attorney. Do I need a real estate attorney?
Hi richiedc!

Yes, you can definitely file a law suit against your aunts claiming that your grandmother was not in her proper senses when she signed the deed. You can definitely take the help of a real estate attorney so that the lawsuit is successfully resolved in your favor.

Thanks.

All of my aunts say that my grandmother was fine mentally. Will her doctor be a help if we bring him to court? I witnessed the amount of medication, and it was enough to bring down a small elephant.

Hi richiedc!

Yes, you can take the help of the doctor who was treating your grandmother. But you should look into it that the doctor supports you. If he/she doesn't then it will be of no help to you. You can ask your attorney to speak to the doctor.

Thanks.
