My parents prepared a living trust and signed a quit claim deed which was notarized and never filed it with the county recorder. they have both passed away. can i now file the deed with the county recorders office to avoid probate?

is a notarized quit claim deed that was never filed with the county recorder still valid to file with the county recorder. it was meant to be transfered into my parents living trust but they never did.

A quit claim deed should be immediately filed after it has been signed. I don't think your parents will be able to file that old quit claim deed with the county recorder now. They might have to sign a new deed and transfer their property in the living trust.

You may record the deed now. The deed is valid even though it was not recorded. Recording a deed is not a requirement for validity, only for notice to third parties or multiple deeds.
