DO I NEED TO GET A QUITCLAIM DEED?

MY HUSBAND AND I ARE BEHIND ON OUR MORTGAGE PAYMENTS. WE HAVE RECENTLY SEPARATED AND HE IS NOT GOING TO HELP ME WITH THE PAYMENTS. I AM STILL LIVING IN THE HOUSE. BUT IT IS ABOUT TO GO INTO FORECLOSURE. I HAVE APPLIED FOR A LOAN MODIFICATION. DO I NEED TO GET MY HUSBAND TO SIGN A QUITCLAIM DEED?

you can ask your husband to sign a quit claim deed in your favor which will help you in becoming the sole owner of the property. once you become the sole owner of the property, it will be easier for you to negotiate with the lender for a loan modification. however, if your husband's name is mentioned on the mortgage docs, then he will have apply for the modification jointly with you.
