my little brother was divorced today after his wife (now ex-wife) left him for another life. in court the judge advised him to get a quit claim deed for his home which she wants nothing to do with. her name is not on the deed or on the mortgage since he had both prior to their getting married. he wrote her a check in the amount they had agreed on and she bolted from the courthouse before signing the quit claim deed. since she has the money, he (and the whole family) is very doubtful she will meet with him to sign the document at the notary. since her name is not on anything tied to the house and the judge did not directly order it, is it necessary to persue?
Probably you need to go back to court and get this legally on a paper.

You have mentioned that the ex-wife's name was not on the property deed or on the mortgage. In such a situation she does not have any ownership rights to the property. Thus, your brother will not have to make her sign the quitclaim deed. He is the sole owner of the property and will remain so.
