how can i get an ex husband who is living with me to sign the deed to our home over to me so i can sell the house. he is not on the mortgage .

he is not working and paying any bills he is an alcoholic and is destoying the property with his druken fits. i cant get him out of the house long enought to get it cleaned to sell and he wont sign a contract with a realtor to sell. i cannot live with him and feel safe. i am actually not sure how his name got on the deed at closing since he has bad credit and is not even on the loan. how can i get him off the deed so i can sell the house. i would sign a document givng him 50 % if the profit if he will get out and let me sell the house. he is destroying my health and the house. he drinks constantly and stays drunk weeks at a time. i need a way to get him out of the house to get it ready to sell and keep him away while it is listed

Welcome to forums!

You will have to ask your ex-husband to sign a quitclaim deed and transfer the property to you. Once he does so, you will become the owner of the property. Then you can sell off the property without your ex-husband's permission.

he will not sign even though i pay him 50 percent of the net profit. he would like for me to loose all my equity as spite even though he is loosing as well. he is drunk all the time and will not sign the deed therefore putting me in a position to walk off and leave my home and loose my lifes work. it is impossible to stay and the law allows him to stay since he is on the deed. any more ideas>

Hi Guest,

If your name is on the property deed, then you can apply for a partition lawsuit. The court will order the sale of the property and the sale proceeds will go toward paying off the mortgage. If there is any excess amount, then it will be divided amongst both of you.
