HI, MY FATHER GOT INTO SOME TROUBLE AND WENT TO JAIL. WHILE HE WAS IN JAIL HE WAS UNDER SUICIDE WATCH AND MENTAL CARE FOR OVER TWO WEEKS. ONE OF HIS FAMILY MEMBERS WENT UP TO THE JAIL AND TRICKED HIM INTO SIGNING A QUICK CLAIM DEED FOR HIS HOME AND LAND. CAN HE GET HIS HOME BACK? THIS HAPPENED IN APRIL 2010. HE IS STILL IN PRISON. I AM HIS DAUGHTER, SO CAN I HELP HIM GET IT?

This is actually a very common story, someone tricks and cons the homeowner into signing away their property without receiving a penny for it. The best thing to do is to consult an attorney. The family member can possibly be charged with exploitation of a disabled adult. However, I am a Mortgage Consultant, not an attorney so be sure to double check this with your lawyer and see what options you can take.

If somebody has scammed your father and made him sign the property papers, then it will be considered as illegal. It will be better if you could contact a real estate attorney and take his help in reversing the deed. Your father may have to file a lawsuit in this regard.
