My Dad died and his property is listed in three names (myself and my siblings). One of the three is not willing to be involved with the mortgage or the upkeep. How can that person sign over his part?
i haven't found any problem (no matter how big it may be) which can not be solved with discussion.If somebody is reluctant to come forward for discussion you can either give it in writing to the court that this person is not willing to pay the mortgage so he should not get any part in property.
With the fear of loosing the property and the official documents he will surely turn up to sign.

Hi seandde,
Since the person is unwilling to be involved with the mortgage, you can ask him to sign a quit claim deed to transfer his property share to the rest of you and then you can have it refinanced in your names thereby removing him from the loan.
