My mother and I own a building together she is on the deed. My mother passed in 2008. I have a son Can I add his name to the deed? or will this be an issue when I pass.

You can add your son to the property deed with the help of a quitclaim deed. This won't be an issue when you pass away. However, have you removed your mother's name from the property deed? You can file her death certificate at the county recorder's office and get her name removed from the property deed.
