my mother's husband has advanced alzheimers and has just been moved to a nursing home. the house they own is in florida and he/she will be living in indiana so my mother will be selling the florida home. she has a durable poa but the real estate agent is requesing a quit claim deed before she will list the propery. can my mother sign the quitclaim deed on her husband's behalf via the durable poa - seems like that would be a conflict of interest. would appreciate your advice. thanks, amy

As your mother has a durable power of attorney on her husband's behalf, she will be able to transfer the property in her name by using a quit claim deed. Once this is done, she can list the property in the market and sell it off.
