my mother-in-law recently lost her husband. she and her husband owned their home in detroit. she wants to sell her home and move to georgia to be near her family. my step father-in-law did not have a will. however, he had filed a quit deed removing the names of a sister and niece and adding my mother-in-law's name several years before his death. since my mother-in-law can't get a decent price for her home at this point in time, my husband and i are willing to purchase the home from her at a fair price. what steps do we need to take to make this purchase? the house is mortsgage free and this would be a cash transaction.
I faced a similar situation. I hired a real estate attorney who made sure everything was done legally.
Your mother-in-law will have to remove her husband's name from the property first. Once this is done, she can file a quitclaim deed and transfer the property to you. The sale price of the property should be mentioned in the property deed.
