My wife and I bought a house about 3 months ago. Her name is on the title but not the mortgage loan. For the past 7 to 8 years she has be fight with her student loans, she has a medical condition that prevents her from working. Well to make a long story short she received a letter in the mail from the Education Department say her loan was in default. She is worried that they may try and take the house or put a lean on it. Is there any way to have her name removed from the title????
Yes you can have her quit claim it to you. However if you are ina community property state it may not make a difference.

I agree with Brain that your wife can simply quitclaim her share of the property to you to remove her name from the deed. As she is not on the mortgage the lender should not have any problem if she quitclaims the property to you.
