terminate a quit claim deed/life estate

Posted on: 02nd Sep, 2010 07:37 am
hi:
i had stage iv lymphoma 3 years ago. at the time, it was very serious and i was not expected to survive. i signed a quit claim deed with my partner. i now am addressed as life estate. i am in remission from the cancer and would like to terminate the deed. how do i go about doing this?
Hi joejnaas,

You cannot simply terminate the deed. You will have to ask your partner to sign a quit claim deed and transfer the property back to you. Once he does so, you would become the owner of the property.

Thanks

Both our names were previously on the deed. If I get him to sign a quit claim deed, wouldn't that negate his name as a deed holder?

Hi Joe!

Welcome back to forums!

Once the person signs the quit claim deed in your name, he will not remain on the deed any more. Thus, he won't remain the owner of the property.
