Quit Claim

Posted on: 02nd Jan, 2009 07:42 pm
Does anyone know anything about Quit Claims? I signed one 3 years ago to get off of a Time Share with my ex-wife. I recorded it with the County Recorders office and had it notorized. She went with me when I did it, but didn't sign it anywhere, because there was no place for her to sign. Today, (3 years later) I got a bill from the Time Share company saying that she has stopped paying and that I need to start paying. It is in collections! I am now worried that I should have had her sign it, or that I didn't follow through in some way. Any suggestions?
hi samiam,

signing a quitclaim deed does not release your from the liability of paying the mortgage. if the person to whom you quitclaimed the property, did not refinance the mortgage, then you will still be liable to pay the dues. i guess your ex-wife did not refinance the property in her name. so the timeshare company now wants you to pay the dues. i think you will have to negotiate with your ex-wife and ask her to pay the dues. if she doesn't then you will have to pay the dues.

thanks
