am I a first time home buyer

short story married house was purchased on his va, now divorced no court order for quit claim, but house was signed over to me in quit claim. upside down mortage on the quit claim house. I got tired of hearing he still owned interest in the house. the refi was in ex wifes name. He moved back in the house so I moved out purchased a new house in june 2008 who owns the house and am I a first time buyer He says it is his va and still his house

Legally, it's you who owns the house as your name is on the title. You still have a right to the property. His name is neither on the title nor on the mortgage (as it was refinanced in his ex-wife's name) and thus, has no claim on the property.

A first time home buyer is one who hasn't owned a primary house for the past 3 years. So if you prove that you never owned a primary residence for these 3 years, you would qualify as a first time home buyer.
