i have a quit claim deed that my ex-husband signed for me before my divorce and been paying mortgage and now he wants me out my house and since my name is not on mortgage i feel hopeless, what may i do for him no to be able to take me out, he threatens me all the time when he doesn'r get his way. help!!!!!!!!!!!
Record the Quit Claim deed and the house will be yours, and the mortgage will be his. It's the worst position he can be in, and the best position for you.

Hi RIVERA,

Legal ownership of the property does not depend on whether or not your name is on the mortgage. You can be a legal owner of the property even though your name is not on the mortgage. Thus, as Raymond suggested, you need to record the quit claim deed so the title of the property shows your name. Once your name is added to the title, you will have ownership rights to the property. On the other hand, since you are not on the mortgage you are not responsible to pay it off.
