I am the only one on the mortgage loan, but the grant deed is under my husbands and I as Joint tenants. We recently lost our jobs and been three months late on my mortgage payment...my husband wants to be removed from tittle but I am not sure what forms to file in CA...please suggest.....
quitclaim will do but again you can not be owner as well as the tenant on the same property.so he need to quitclaim it to somebody else other than you.

Your husband's credit will not be affected if you default on the loan. Since he's not on the loan, he's not responsible for it. Being on the property title does not make him liable for the loan. But if he still wants to remove his name from the title, he can sign a quit claim deed and transfer his share of the property to you.

thank you guys for the information provided. We are now working with the lender to see if they can modify the loan. but since the only income are from Disability and unemployment. I really dought they will be willing to help. They are hungry for money!! and are really hard to work with. any comments?
guest, do you have any other home ,may be your father, mother, brother, sister or your husband's any relative.
If the condition becomes worse then ]contact your relatives and ask if they can accommodate you for temporary period. by that time you and your husband can work part time and get some monetary stability where you can think of paying some rent to your relatives for their help as well as make sure you are paying for the mortgage in some way so that you can save your home from foreclosure, shortsell.
I think if you can find any low paying job which is enough to pay the rent of the house then also it will suffice the requirement.
