If my 90 year old mother quitclaims her home to me and some day ends up in a nursing home can the nursing home come after her home for payment? Also is there a time from when the quitclaim is filed to when the nursing home could do this in Iowa
Hi garyriden,
If your mother requires Medicaid to pay for the nursing home bills, a transfer now can make her ineligible for medicaid as it comes with a look back period of 5 years, which implies that if you had a property that you quitclaimed to someone within the last 5 years prior to entering a nursing home, the govt. will have the right reverse the deed or place a lien on the property. Thus, if your mother quitclaims it now and then ends up in a nursing home in next 5 years, the nursing home can come after the home for payment.
