how to get a name off of a quit claim deed

Posted on: 18th Jun, 2009 06:24 pm
i quit claimed my house into my ex husbands sisters name on behalf of him.(we were not married at the time)we did that just till we could get married.now that we were married and now divorced, she wants half of the house even though she has never put 1 penny in it.is there anything i can do to get her off the deed?
Unfortunately, the ball is in her court. She would have to deed her ownership interest back to you and that doesn't seem likely from the sound of your post.
Good luck.

Hi daniellecruz,

You added your ex-husband's sister to the title through a quitclaim deed. This means she co-owns the property and has an interest in it. You can get her off the title, only if you can get a quitclaim deed signed by her, whereby she would give up all her interest in the property.

Hi Daniel
Welcome to our forum.

As you say you had added your ex husbands sisters name on deed for behalf.

That means she is the 50% owner of house & if your try to take help of court, court will go in her favor by filled in deed. there is only one way, if she agree to sign quitclaim deed then it will be possible. other viz you have to give her 50 % of the property legally. That's all.

Thanks & Regards.
