Do I need a quit claim deed or warranty deed

Posted on: 22nd Apr, 2009 08:42 am
i bought a property with a cousin. i was married at the time and my cousin was also married at the time. to transfer interests to the property to me do i need a quit claim deed or a warranty deed? does my cousin's spouse also need to sign the deed or not to make it valid?
Hi Guest,

To transfer interest to you, a quitclaim deed can be used. But a warranty deed would be better as it would transfer interest free and clear. Your cousin's spouse may have to sign the deed, if you are living in a community property state.
