Quick Claim Deed

Posted on: 16th Dec, 2009 03:29 pm
8 years ago my parents signed over their house to myself & brother. Everything was done legally through an attorney. Now she wants the house back with a quick claim deed. My father has since passed away and she cannot understand the ramifications of this. She has hired an attorney. Is this possible for her to do?
Welcome lindypac,

The property deed presently has your name and your brother's name. Thus, both of you are the owners of the property. Your mother won't be able to force you to sign a quit claim deed and transfer the property to her. If she does so, it will be considered as illegal. If she forces you to do so, you can contact an attorney and take legal actions against her.

great...dad moves on in death and mom begins a war with their sons. talk of lawyers, lawsuits and "can she do this?"

all of you can go hire lawyers, but wouldn't it be nicer to simply work it out without paying for lawyers?
