My father is hospitalized with either dementia or a nervous break down. He has a condo that is in his name and his former wife, she is recently deceased. We want to put his condo in my name. What is the best way to handle this. He still owns around $35,000. I am not sure if a property transfer, or quitclaim deed or what is the best way to put the condo in my name. We do not want either my father or my step-mother's name on the deed. What is the best way?
Hi populor,
You've mentioned that the property deed is in the name of your father and your step mother who has recently deceased. Thus, your father will have to transfer the property first in his name by filing an affidavit of heirship. Once the property is transferred in your father's name, then he can sign a quit claim deed in your favor and transfer the property to you.
