My husband died, splitting his estate three ways between his two adult children and me. Also, the house that I own and is in my name, and on my demise is to be splint three ways. 1/3 to each of his two children, & 1/3 to my child. The house in the trust along with the rest of the estate monies.
We now want to change all this. We are all in agreement, but not sure how to do it. Should they quit-claim any interest in the home, and I quit-claim any interest in my late husband's estate? Can we do this without an attorney? In other words, I get the house, they get the rest of any money due to me. Any help much appreciated.

hi alandliz!

it is always better to take the help of an attorney in regards to the property transfer. if your husband's property presently includes your names and his two adult children, then you'll have to sign a quit claim deed and transfer the property to them.
as far as your property in the trust is concerned, you can revoke it and change the names of beneficiaries. however, as i've said earlier, you should take the help of a real estate attorney in this regard.
feel free to ask if you've further queries.
