hello,
this past June i signed a quick claim deed to turn over my marital home to my ex-husband. The divorce papers also show he is to retain the property. My ex husband is now telling me that i am still on the title (because his lazy butt did not file the deed w/ the mtg company) but it was signed and filed in the courts before he became in default on the mtg payments.
My question is.. am i really still responsible for this mtg? He is now trying to sell the home for much less than owed and is wanting me to come out of pocket for part of the difference? I thought the quick claim deed prevented all this for me?

Hi tigerlilly,
Welcome to mortgage fit,
Quitclaim deed only transfer the property ownership and do not transfer the mortgage responsibility. So if you are on the mortgage of the house even after transferring the property through quitclaim deed you are still liable to pay the monthly installments.
So according to this, your name should be still on the mortgage docs but not on the deed and thus you seem to be in confusion....
Feel free to ask any further query if you have..........
